ROAD TRAFFIC REGULATION ACT 1984

The East Sussex County Council (Lewes District) (Off-Street Parking Places)

Traffic Regulation Order 2013 (Amendment No.*) Order 202*

East Sussex County Council, in collaboration with Lewes District Council, in exercise of their powers under sections 32, 35, 39(6) and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (hereinafter referred to as "the Act of 1984"), as amended by the Parking Act 1989 and the Road Traffic Regulation Act 1991, Traffic Management Act 2004 and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 of the Act of 1984, hereby makes the following Order:

1.   When this Order comes into effect

 (a)    The East Sussex County Council (Lewes District) (Off-Street Parking Places) Traffic Regulation Order 2013 as amended, shall have effect except as hereinafter contained.

2. Amendment to Part I General  Article 3  - Interpretation

i) Delete the definition for “electric vehicle ” and insert a new definition as follows:

“electric vehicle or EV” means a motor vehicle that can be powered, partially or wholly, by an electric motor that draws electricity from a battery and is capable of being charged from an external source, which for the avoidance of doubt shall include hybrid and plug-in hybrid.

ii) Insert the definition “electric vehicle charging bay” to be defined as follows:-

“electric vehicle charging bay” means a Parking Bay within a Parking Place identified by surface markings and/or signage for the exclusive use of Electric Vehicles whilst that Vehicle is being charged by means of an Electric Vehicle Charging Point

iii).  Insert the definition “electric vehicle charging point” to be defined as follows:-

          “electric vehicle charging point” mean a purpose built unit designed to connect an Electric Vehicle to a source of electricity to recharge Electric Vehicles.

iv) insert the definition “motor vehicles” to be defined as follows:-

“motor vehicles” means a vehicle including an electric vehicle (other than a motorcycle or motorhome) constructed or adapted for use on roads and not drawing a trailer.

3.  Amendment to Part II Use of Parking Places

     Insert a new  article 4.1  

4.1  No person shall use an Electric Vehicle Charging Bay, designated as such by sign, surface marking, or Parking Place Notice, for any purpose unless it is an Electric Vehicle that is connected to and in the process of receiving an active electrical charge from an immediately adjacent Electric Vehicle Charging Point.

Insert a new article 9.1 Payment of charge

9.1  The Driver of an Electric Vehicle must display a Parking Ticket in the Relevant Position whilst that Electric Vehicle is connected to and in the process of receiving an active electrical charge from an immediately adjacent Electric Vehicle Charging Point.

               Insert a new article 21. (l) Contraventions in a parking place and penalty charges

21. The Driver of an Electric Vehicle shall pay a Penalty Charge if an Electric Vehicle is parked in an Electric Vehicle Parking Bay during the operational times  but then exceeds the maximum amount stay time. Any non-Electric Vehicle or Electric Vehicles not receiving an active charge in an Electric Vehicle Parking Bay may receive a Penalty Charge Notice. For the avoidance of doubt, users may not move to an alternative Electric Vehicle Parking Bay within the period of no return but, subject to the relevant Parking Place's maximum stay, may move to a standard Parking Bay subject to the payment of the appropriate Parking Charge.

4. Amendment to Schedule 1 -Off Street Parking Places and Operational Details

Delete in its entirety Schedule 1 and insert a new Schedule 1(as appended to this Order). The effect of the new schedule is to introduce an amendment as follows:

In column 5 of all the car parks listed insert a new row in the ‘Specific user bay, a new User Type as follows:

“electric vehicles” parked in the EV bay within a EV parking place having paid the tariff to park in the bay and are actively charging the vehicle.

5.   Citation

This Order may be cited as “The East Sussex County Council (Lewes District) (Off-Street Parking Places) Traffic Regulation Order 2013 (Amendment No.*) Order 202*” and shall come into operation on xxxxxxxxxxxxx.
